Effective January 1, 2021, the California Family Rights Act (CFRA) applies to employers with five or more employees. Employers that have five or more employees must provide up to 12 weeks of job-protected leave to eligible employees when leave is needed for the employee’s own serious health condition, to care for a family member who has a serious health condition, (spouse, registered domestic partner, child, child of registered domestic partner, parent, siblings, grandparents, or grandchildren); for qualifying reasons related to active military duty of an employee’s spouse, domestic partner, child or parent; and baby bonding (includes adoption and foster care placement).
The California Department of Human Resources provides a leave and notice form. For employers who have been using these available forms in the past, and for those employers new to the CFRA forms, the notice form has been updated effective January 1; the old form(s) are no longer compliant.
